“Las Cortes Generales y extraordinarias de la Nación española, decretan la siguiente Constitución:
Art. 1. La nación española es la reunión de todos los españoles de ambos hemisferios
Art. 2. La nación española es libre e independiente, no es ni puede ser patrimonio de ninguna familia ni persona.
Art. 3. La soberanía reside esencialmente en la nación, y por lo mismo pertenece a ésta exclusivamente el derecho de establecer leyes fundamentales.
Art. 4. La nación está obligada a conservar y proteger con leyes sabias y justas la libertad civil, la propiedad y los demás derechos legítimos de todos los individuos que la componen (…)
Art.8. También está obligado todo español, sin distinción alguna, a contribuir en proporción de sus haberes para los gastos del Estado (…).
Art. 12. La religión de la Nación española es y será perpetuamente la católica, apostólica, romana, única verdadera. La Nación la protege por leyes sabias y justas, y prohíbe el ejercicio de cualquier otra (…).
Art. 14. El Gobierno de la Nación española es una Monarquía moderada hereditaria.
Art. 15. La potestad de hacer las leyes reside en la Cortes con el rey.
Art. 16. La potestad de hacer ejecutar las leyes reside en el rey.
Art. 17. La potestad de aplicar las leyes en las causas civiles y criminales reside en los tribunales establecidos por la ley (…)

The Constitution of 1812
Main ideas.
• Spanish government is now a constitutional monarchy, art 14, the power of the monarchy was limited by the law.
• National Sovereignty is reflected, art 3, it was a most revolutionary principle because in the Ancient Regime the sovereignty was in the king.
• The Constitution also contained citizen rights, art 4, as freedom, property, and right of education are reflected in art 366.
• Equal before the taxes, art 8, ending privileges nobility and clergy.
• The Constitution takes the separation of powers: legislative, executive and judicial (art 15-17) according with the Montesquieu principles.
• Suffrage, the right to participate in the political system, was reflected in art 34.
• Catholicism remained the state religion, art 12, but there aren´t freedom of worship.
The constitution of 1812 was the first Spanish constitution and had extremely influence in all Spanish constitutions in 19th century and also served as a model for the liberal constitutions of several European and Latin American nations. This constitution ended de Ancient Regime and the absolute monarchy and build a new liberal estate and a constitutional monarchy.
The historical context helped to develop a liberal political system. In 1808, both King Ferdinand VII and his predecessor and father, Charles IV, had resigned their claims to the throne in favour of Napoleon Bonaparte, who in turn passed the crown to his brother Joseph. Spaniards didn´t accepted Jose Bonaparte as a king, There was no official power and to repel the invasion, people create a legitimate government to represent the Spanish people. This situation make possible that people rules themselves, without the War of the Independence, liberal revolution in Spain, which more important attainment was “ La Pepa”, couldn´t be possible.
